What legal rights does a condo/TIC owner/resident have when the other owner does noisy remodeling?

friend of sf resident asked:


I have a friend who owns a two unit building with his ex wife. He is living in one unit and will be moving out in a month; she has evicted the other tenant for an owner move in and has started remodeling the other unit. This entails loud construction at early hours of the morning and through the day, which is giving his new wife headaches and has contributed to a seizure for their dog. Do they have any legal rights to delay the construction or to be compensated for temporary housing if their unit becomes unlivable?

Depends on the time of the day…..

But basically no…..

It usually starts at sun up….

you can file complaints, but then they know its you and it creates a hostile environment.

Good Luck…

Check your local ordinances at city hall, and call your local police and ask they will tell you what the laws of you township or city are.

usually they can do it during normal day hours but if it is extremely loud call the police
